CARVEOO
Procedures and entitlements applicable to Hosts and Guests in the event of a Major Disruptive Event affecting the Platform or operations on Curaçao
1. Purpose & Scope
This Major Disruptive Events Policy ("MDE Policy") sets out the rights, obligations, and procedures applicable to Hosts and Guests registered on the Carveoo Platform in the event of a Major Disruptive Event. This Policy supplements and must be read in conjunction with the Host Terms & Conditions, the Guest Terms & Conditions, and the Host Policies & Regulations.
2. Definition of a Major Disruptive Event
A "Major Disruptive Event" (MDE) is an extraordinary, unforeseen event or circumstance that is beyond the reasonable control of Carveoo, a Host, or a Guest, and that materially prevents or impairs the performance of obligations under a confirmed Booking. MDEs include, but are not limited to:
2.1 Natural Disasters & Extreme Weather
Hurricanes, tropical storms, or severe weather warnings issued by the Meteorologische Dienst Curaçao (MDC) or equivalent authority;
Floods, earthquakes, or other natural disasters causing significant disruption to travel or road infrastructure.
2.2 Public Health Emergencies
Declaration of a public health emergency or epidemic by the Government of Curaçao, the Kingdom of the Netherlands, or the World Health Organization (WHO);
Government-mandated lockdowns, curfews, or travel restrictions directly preventing the use or return of a Vehicle.
2.3 Civil & Political Unrest
Officially declared states of emergency;
Large-scale civil unrest, riots, or government-imposed restrictions on public movement.
2.4 Infrastructure & Utility Failures
Island-wide or large-scale road closures due to government order or force majeure;
Prolonged and widespread failure of utilities or telecommunications infrastructure directly affecting the operation of the Platform.
2.5 Other Force Majeure Events
Any other event qualifying as force majeure (overmacht) under the laws of Curaçao, provided it directly and materially impacts the ability to perform Booking obligations.
3. Determination of an MDE
Carveoo holds the exclusive right to determine whether a specific event qualifies as a Major Disruptive Event under this Policy. In making such a determination, Carveoo will consider:
Official declarations, warnings, or advisories issued by governmental or regulatory authorities of Curaçao or the Kingdom of the Netherlands;
Verifiable impact on travel, road infrastructure, or the ability to use, pick up, or return Vehicles;
The geographic scope and severity of the disruption.
Carveoo will communicate MDE determinations through the available Platform support process, email and/or website. Where possible, advance notice will be provided. This does not guarantee a particular delivery or response deadline.
4. Effect on Bookings
4.1 Bookings Directly Impacted by an MDE
Where Carveoo determines that a confirmed Booking is directly and materially affected by an MDE, the following provisions apply:
a) Cancellation by Either Party
Either the Guest or the Host may cancel the Booking without financial penalty for the duration of the MDE period.
The standard Host cancellation policy is suspended for Bookings cancelled pursuant to a declared MDE.
b) Refund Entitlements
Guests who cancel during a declared MDE will receive a full refund of the rental amount paid, including the Guest Service Fee, irrespective of the Host's standard cancellation policy.
No Platform credit or voucher service is currently activated. This policy does not substitute an unavailable credit or voucher for its stated monetary refund entitlement.
c) Host Payouts During an MDE
Payouts for Bookings cancelled under this Policy will not be issued to Hosts.
Carveoo will not charge Hosts a cancellation penalty for cancellations made in accordance with a declared MDE.
4.2 Ongoing Rentals During an MDE
For Guests who are already in possession of a Vehicle at the time an MDE is declared:
The Host must maintain 24/7 support and make reasonable efforts to assist the Guest in returning the Vehicle safely;
The Rental Period may be extended, at no additional charge to the Guest, where the MDE directly prevents timely return. Any extension or alternative return arrangement requires Host–Guest communication and an authorized reservation review; it is not automatically booked or guaranteed by the Platform.
The Host and Guest must communicate via the Platform regarding any extension or alternative return arrangement.
Carveoo may intervene to coordinate assistance where neither party can reach the other, in accordance with Section 8.3 of the Host Policies & Regulations.
5. Obligations of Hosts During an MDE
During a declared MDE, Hosts must:
Maintain 24/7 availability and respond to Guest communications without undue delay;
Accept cancellations made by Guests in accordance with this Policy without objection;
Cooperate with Carveoo's coordination efforts, including providing information regarding vehicle location and Guest status;
Prioritise Guest safety over commercial considerations at all times.
Failure to cooperate during a declared MDE may result in account suspension and/or recovery of costs incurred by Carveoo in providing assistance.
6. Obligations of Guests During an MDE
During a declared MDE, Guests must:
Follow instructions issued by the Host and Carveoo regarding vehicle return or alternative arrangements;
Report their location and vehicle status to the Host and Carveoo where requested;
Take reasonable steps to safeguard the Vehicle from damage or theft;
Comply with all instructions and ordinances issued by governmental authorities of Curaçao.
7. Exclusions
This Policy does not apply to:
Events that were reasonably foreseeable at the time the Booking was confirmed (e.g. a known approaching storm for which no official warning had been issued);
Personal circumstances of the Guest or Host that do not constitute an MDE (e.g. illness, travel delays, vehicle maintenance issues);
Cancellations or disruptions arising from a Host's failure to comply with vehicle standards or insurance requirements.
8. Claims & Reimbursement Process
To initiate a claim under this Policy, the affected party must:
Submit a written request via the Carveoo Platform or to support@carveoo.com within 72 hours of the relevant event;
Reference the relevant Booking ID and provide a brief description of the MDE's impact;
Supply any supporting documentation requested by Carveoo (e.g. official warnings, photographs, correspondence).
Carveoo will assess and respond to MDE claims through its available support and review process. No fixed response deadline is guaranteed. Decisions remain subject to mandatory applicable law. Any approved refund or payout consequence is a review decision and does not itself transfer funds; real financial transfers remain disabled pending the approved integration.
9. Liability of Carveoo During an MDE
Carveoo shall not be liable for any losses, damages, or costs incurred by Hosts or Guests as a direct or indirect result of a Major Disruptive Event. This includes, but is not limited to:
Loss of rental income or anticipated revenue;
Vehicle damage resulting from the MDE;
Additional accommodation, transport, or subsistence costs;
Delays in Platform functionality or payment processing caused by the MDE.
Carveoo will endeavour to communicate updates and take reasonable steps to assist affected parties, but cannot guarantee service continuity in the event of a severe MDE.
10. Communication
In the event of a declared MDE, Carveoo will communicate with Hosts and Guests through:
Available Platform communications;
Email communication to registered account holders;
Updates published on the Carveoo website. No separate automated MDE broadcast service is promised.
Hosts and Guests are responsible for ensuring their contact details are accurate and up to date at all times.
11. Amendments to this Policy
Carveoo reserves the right to amend this MDE Policy. Material amendments will be communicated via the Platform. Required acceptance of applicable revised terms must be intentional and versioned; continued use alone does not replace that acceptance.
12. Governing Law & Jurisdiction
This Major Disruptive Events Policy is governed by and construed in accordance with the laws of Curaçao. Any disputes arising from or in connection with this Policy shall be submitted to the competent courts of Curaçao (Gerecht in Eerste Aanleg van Curaçao), unless mandatory provisions of applicable law provide otherwise.
